1. Acceptance of Terms

By accessing and using WPWriter ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

For customers subject to the GDPR, our Data Processing Agreement forms part of these Terms of Service and is incorporated into them by reference.

2. Description of Service

WPWriter is an AI-powered WordPress content management system that allows users to:

Generate and manage WordPress content using AI technology (OpenAI, Claude, or Gemini)
Connect to WordPress sites via multiple connection methods (REST API, FTP, OAuth)
Manage posts, pages, and SEO metadata for their own WordPress websites
Create content in multiple languages (Hebrew, English, Arabic)

BYOK (Bring Your Own Key) Architecture

WPWriter operates on a Bring Your Own Key (BYOK) model. Users provide their own API keys for AI providers (OpenAI, Claude, or Gemini). This architecture:

Prevents anonymous or untraceable AI usage (all activity tied to user's own API account)
Ensures users control their AI spending directly with the provider
Reduces spam and abuse risk (users' own API keys enforce provider-level rate limits and policies)
Provides transparency and accountability for AI content generation

Two exceptions run on WPWriter's own provider keys: the free trial for users who have not added a key, and the paid AI Image Pack. Both are subject to Section 4, including the adult-content rule in 4.3.

Usage Limits: To maintain platform integrity and prevent infrastructure abuse, we enforce tier-based usage limits (15 one-time content generations on the free plan, and 60-300 content generations per month on paid plans, depending on subscription tier).

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security of your password and account
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy and Prohibited Activities

You are solely responsible for how you use WPWriter and all content generated through the Service. The following activities are strictly prohibited and may result in immediate account suspension or termination:

4.1 Spam and Mass Content Abuse

No Spam Generation: Do not use the Service to create spam content, mass-generated low-quality articles, or content farms
No Automated Abuse: Do not automate content generation for the purpose of manipulating search engines, flooding platforms, or deceiving users
No Bulk Publishing: Do not use the Service to publish large volumes of thin, duplicate, or manipulative content designed solely to game algorithms

4.2 Copyright and Intellectual Property

No Copyright Infringement: Do not knowingly publish AI-generated content that infringes copyrights, trademarks, or other intellectual property rights
No Plagiarism: Do not use the Service to copy, republish, or paraphrase content from other sources without proper attribution or permission
Respect Third-Party Rights: Ensure all published content respects the intellectual property rights of others

4.3 Deceptive and Illegal Content

No Illegal Content: Do not create or publish content that promotes illegal activities, violence, hate speech, or discrimination
No Deceptive Practices: Do not use the Service to generate misleading, fraudulent, or deceptive content intended to manipulate or harm users
No Misinformation: Do not knowingly publish false medical, financial, legal, or safety-critical information that could cause harm
No Impersonation: Do not use the Service to impersonate individuals, organizations, or brands
No Adult Content on WPWriter's Own AI Keys: The free trial and the AI Image Pack generate with API keys owned by WPWriter. Do not use them for sexually explicit or adult content. Such content, where lawful, requires your own API key and is subject to that provider's policies

4.4 Search Engine and Platform Manipulation

No Black-Hat SEO: Do not use the Service for deceptive SEO practices such as keyword stuffing, cloaking, hidden text, or link schemes
Google Guidelines Compliance: Content must comply with Google's Webmaster Guidelines and spam policies
Platform Policy Compliance: Published content must not violate WordPress, social media, or other platform terms of service
No Algorithmic Manipulation: Do not generate content solely to manipulate search rankings, engagement metrics, or recommendation algorithms

4.5 Technical and Security Abuse

No Unauthorized Access: Do not attempt to gain unauthorized access to the Service, other users' accounts, or connected systems
No Service Disruption: Do not interfere with, disrupt, or overload the Service or its infrastructure
No Malware Distribution: Do not use the Service to distribute malware, viruses, or harmful code
No API Abuse: Do not reverse-engineer, circumvent rate limits, or abuse the Service's APIs

4.6 User Responsibility Statement

YOU ARE SOLELY RESPONSIBLE for all content generated, published, or distributed using WPWriter. This includes compliance with all applicable laws, regulations, platform policies, and third-party rights. WPWriter is a tool provider and bears no liability for user-generated content or its use.

5. AI Content Disclaimer and Limitations

WPWriter uses third-party artificial intelligence models to generate content. By using our AI content generation features, you acknowledge and accept the following:

5.1 Content Accuracy and Quality

No Guarantee of Accuracy: AI-generated content may contain factual errors, inaccuracies, outdated information, or inappropriate material
No Completeness Guarantee: Generated content may be incomplete, lack context, or miss critical information
Potential Bias: AI models may reflect biases present in their training data
Unpredictable Output: AI may occasionally produce unexpected, nonsensical, or contextually inappropriate results

5.2 Legal and Compliance Risks

Copyright and Intellectual Property: Generated content may inadvertently resemble existing copyrighted works. Users must ensure content does not infringe third-party rights
Legal Compliance: Content may not comply with applicable laws, regulations, or industry standards in your jurisdiction
Platform Policy Violations: Generated content may violate policies of Google Search, WordPress.com, social media platforms, or other third-party services
No Legal Advice: Any content generated should not be construed as legal, medical, financial, or professional advice

5.3 User Obligations

Mandatory Review: You MUST independently review, fact-check, and validate all AI-generated content before publishing or distributing it
Editorial Responsibility: You are solely responsible for editing, correcting, and approving all content before publication
Human Oversight: AI-generated content should be treated as a draft requiring human judgment and editorial oversight
Content Ownership: While you retain ownership of content created using the Service, you accept full liability for its use and publication

5.4 No Guarantees or Warranties

No SEO Guarantees: We do not guarantee that AI-generated content will improve search engine rankings, increase website traffic, or achieve any specific business outcomes
No Performance Promises: Results may vary significantly based on content quality, website authority, competition, and numerous other factors beyond our control
"As-Is" Service: AI content generation is provided "as-is" without warranties of any kind, express or implied

6. WordPress Site Access

When connecting your WordPress site to WPWriter, you grant us permission to:

Access your WordPress site using the credentials you provide
Create, read, update, and delete content on your behalf
Access and modify SEO metadata and settings

You are responsible for ensuring you have the necessary permissions to grant this access.

7. Subscription and Payments

WPWriter offers a free tier, paid subscription plans and paid add-ons such as the AI Image Pack, at the prices shown on the pricing page. We reserve the right to:

Introduce, change or withdraw plans and add-ons
Modify pricing and features with reasonable notice
Offer different tiers of service

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by WPWriter and is protected by international copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, WPWriter shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

10. Account Suspension and Termination

We take violations of these Terms of Service seriously and will enforce them rigorously.

10.1 Grounds for Suspension or Termination

We reserve the right to immediately suspend or terminate your account, without notice or refund, if you:

Violate any provision of these Terms of Service, including the Acceptable Use Policy
Generate or publish spam, illegal content, or content that infringes third-party rights
Engage in deceptive SEO practices or platform manipulation
Abuse the Service's infrastructure, APIs, or technical systems
Create multiple accounts to circumvent usage limits or tier restrictions
Engage in fraudulent billing or payment disputes
Harm other users, WPWriter, or third parties through your use of the Service

10.2 Enforcement Actions

Depending on the severity and nature of the violation, we may take the following actions:

Warning: First-time or minor violations may result in a written warning and opportunity to correct the issue
Temporary Suspension: Serious or repeated violations may result in temporary account suspension (7-30 days)
Permanent Termination: Severe violations (spam, illegal content, fraud) may result in immediate permanent account termination
Legal Action: We reserve the right to pursue legal action for serious violations that cause harm or violate laws

10.3 Effect of Termination

Upon account termination:

Your access to the Service will be immediately revoked
No refunds will be issued for unused subscription time (except as required by law)
We may retain certain data for legal compliance, fraud prevention, and audit purposes
You may not create a new account without our express written permission

10.4 Voluntary Cancellation

You may cancel your account at any time through your account settings. Upon voluntary cancellation, you will retain access to paid features until the end of your current billing period. See our Refund Policy for information about refund eligibility.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date.
